Normative Bases

The argument for this Bill rests on the principle that the state has a profound moral and utilitarian obligation to provide comprehensive healthcare to those injured in its service. By removing arbitrary financial triggers for reviews, the Bill prioritizes health outcomes over bureaucratic cost-containment. From a Utilitarian perspective, the administrative friction caused by expenditure-triggered reviews often leads to a "chilling effect," where veterans or providers may forgo necessary treatment to avoid the burden of additional paperwork or the risk of denial [Judgment].^[1] This can lead to the deterioration of chronic conditions, ultimately costing the healthcare system more in the long run through emergency interventions or increased disability support.

Furthermore, the Bill supports Individual Autonomy by ensuring that the relationship between a veteran and their clinician remains the primary driver of care. When a government imposes a $5,000 threshold, it effectively inserts a third party—the bureaucracy—into the clinical decision-making process based solely on a dollar figure rather than a medical diagnosis. As the explanatory memo notes, this Bill ensures that "access to allied health treatment... is determined by clinical need" [Explanatory Memo, page 2]. This promotes the Legal Principle of the right to health by ensuring that veterans with complex, high-cost needs are not disadvantaged or subjected to greater scrutiny than those with less severe injuries, ensuring equal access to the "highest attainable standard of physical and mental health" [Explanatory Memo, page 6] [Judgment].

^{^}
The "chilling effect" refers to the psychological and administrative burden that discourages individuals from seeking a benefit due to the complexity or perceived risk of the process.
